Registrar and Commissioner of Titles Joint Practice: Verification of Identity
We are pleased to advise that the Registrar and Commissioner of Titles Joint Practice: Verification of Identity (the Practice) is now finalised. The final Practice has substantial changes from the Consultation Draft dated 12 March 2012 as a result of feedback received.
The Practice is designed to reduce the opportunity for successful land title fraud as a result of identity theft or other improper dealings by confirming the identity of a person transacting and their authority to deal with that parcel of land.
While based upon the proposed verification of identity standard being considered for introduction nationwide as part of National Electronic Conveyancing, the Practice applies only to documents executed on paper. The Practice sets out the minimum standard of Verification of Identity for registered proprietors and others who sign a range of real property documents that are to be lodged with Landgate.
The verification of identity standard required in the Practice has two base requirements:
(a) Identity Document Production: Production of current, original identity documents from the categories in Table 1 or Table 2 at Appendix B; and
(b) Visual Verification of Identity: A visual 'face to face', comparing the photograph on the current original identity documents with the person being identified.
The Practice has a six month transitional implementation period that starts on 1 July 2012. Full compliance is expected on documents lodged on 2 January 2013.
