Regulations mandating the use of electronic conveyancing came into effect on 1 May 2018, with an exemption granted until 1 December 2018.
For transactions entered into from 1 December 2018, electronic lodgement will become the standard process in Western Australia.
The following transactions will be required to be lodged electronically:
- all eligible, stand-alone transfers, caveats and withdrawal of caveats
- any lodgement case consisting of eligible discharge, transfer, mortgage, caveat and withdrawal of caveat
- eligible land title documents
The Registrar and Landgate have worked with industry to implement this change over a four-year period since the first e-conveyancing transaction was completed in WA in June 2014.
With the general exemption expiring 1 December 2018, the Registrar encourages industry to transition to electronic conveyancing over the next two months.
